These Terms of Service (“Terms”) form a binding agreement between you and Prophetic Media Solutions, LLC, a Florida limited liability company (“Company,” “we,” “us”). By creating an account or using Night, Night Hero (the “Service”) you agree to these Terms. If you do not agree, do not use the Service.
Eligibility
You must be at least 18 years old and the parent or legal guardian of any child for whom you create a profile. The Service is not directed to children and children may not create accounts.
Your account
- You are responsible for keeping your login credentials secure.
- You are responsible for activity that occurs under your account.
- You agree to provide accurate information and to keep it up to date.
Subscriptions and billing
- The Service is offered as a monthly subscription with tiered pricing by number of children: $8.99 (1 child), $11.99 (2 children), $14.99 (3 children).
- New accounts include a 7-day free trial. You will not be charged during the trial. If you do not cancel before the trial ends, your card will be charged the applicable monthly fee.
- Subscriptions renew automatically each month until cancelled.
- Payments are processed by Stripe. By subscribing you also agree to Stripe’s terms.
- We may change pricing with prior notice; changes will not apply to a billing period already paid for.
Cancellation and refunds
You may cancel at any time from the billing portal in your dashboard. Cancellation stops future renewals; access continues through the end of the paid period. Except where required by law, fees already paid are non-refundable, including partial months. If you believe you were charged in error, contact us within 30 days.
Acceptable use
- Do not use the Service to harass, exploit, or endanger any child.
- Do not attempt to use the Service to generate content that is sexual, violent, hateful, or otherwise harmful to children.
- Do not reverse engineer, scrape, overload, or interfere with the Service.
- Do not impersonate another person or misrepresent your relationship to a child.
We may suspend or terminate accounts that violate these rules, with or without notice.
Content and intellectual property
Stories generated for your account are licensed to you for personal, non-commercial family use. You may read, save, and share individual stories with members of your household. You may not resell, republish, or use the stories to train AI models. The Night, Night Hero name, logo, design, and code are our intellectual property.
AI-generated content disclaimer
Stories are generated by an AI model from a structured prompt. We design prompts and safeguards to produce age-appropriate, character-building content, but AI output can occasionally be unexpected. Parents should preview stories before reading them aloud if a child is sensitive to particular themes. Stories are not professional advice of any kind.
Service availability
We aim for reliable nightly delivery but do not guarantee that the Service or any specific email will be delivered on time or without interruption. We are not liable for missed deliveries caused by upstream providers, your email provider’s spam filtering, or events outside our reasonable control.
Disclaimers
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
Indemnification
You agree to defend and indemnify us against claims arising from your misuse of the Service or your violation of these Terms.
Governing law
These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law principles. Any dispute will be brought exclusively in the state or federal courts located in Florida.
Changes to these terms
We may update these Terms from time to time. Material changes will be announced by email or in-app notice. Continued use after the effective date constitutes acceptance.
